Thousands of owner-drivers are engaged across Australia
However, useful commentary and guidance on the laws applicable to their engagement has been conspicuously unavailable. ABLA recently published the first book "Owner-Driver Law in Australia" by Julian Arndt, Luis Izzo and Nigel Ward.
This is a unique form of contractor engaged by most major transport enterprises, as well as hundreds of smaller operators. In several states, there is specific legislation that applies to these engagements whilst, at a federal level, a range of other laws apply. The legal regime is poorly understood - yet, conversely, the exposure to improperly engaging owner-drivers can be very large, with wide-ranging avenues for legal claims.
Nigel Ward has negotiated 'owner-driver' arrangements across Australia for over 30 years and is considered an expert in this field.
ABLA is leading the way in providing access to information about this sector, the complex legislation, particularly post the latest IR Reforms, and developed tailored training to assist organisations manage their legal obligations.
In addition to having expertise with Owner-Driver arrangements, Nigel Ward and Julian Arndt are members of the 'Supply Chain' sub-committee, chaired by Mr Peter Anderson with FWC Commissioners Connolly and Sloan assisting. This is a sub-committee of the Road Transport Advisory Committee, a new body established to guide the Fair Work Commission on the TWU Applications seeking an order to regulate all supply chains involving a contract driver at that base of the chain. There are three keys areas that businesses need to be across:
- Supply Chain shakeup: FWC proposing major changes
- NSW Government proposes material extension to Chapter 6 - Contract Driver Regulation
- FWC moves on gig work minimum standard orders.
