Wage and super theft: Staying out of jail

On 1 January 2025 the new criminal wage theft laws took effect, signalling a major shift in accountability for employers. Under these changes, intentional underpayments of wages and entitlements can result in severe penalties, including fines of up to $8.25 million for companies and up to 10 years of imprisonment for individuals, such as directors, senior managers, and payroll personnel.

The onset of these new wage theft laws should encourage all businesses to review and update their practices to ensure they are sufficiently robust to safeguard against potential liability.

Join us for our first free webinar of the year where employment law experts, Luis Izzo and Tamsin Lawrence, will provide practical guidance on:

  • Understanding the new criminal wage theft offence
  • The difference between intentional underpayment and genuine mistakes
  • How others involved in an underpayment can also be held criminally responsible too through other ‘related criminal offences’
  • Wage theft investigations, prosecutions and sentencing
  • Understanding and leveraging the two new safe harbour provisions: the Voluntary Small Business Wage Compliance Code and Cooperation Agreements
  • Practical steps to ensure compliance, protect your business and avoid wage theft
  • What to do if you uncover an underpayment in the new era of criminal wage theft.

This webinar is an invaluable opportunity to gain critical insights into this new legal landscape and ensure you, your business and employees are prepared and protected. Register for free now.
